Lenox Place at Sunnyside HOA Monthly Board Meeting Mon., Jul. 26 is Postponed; Special Meeting of the Board Called for Tue., Jul. 27, at 7 pm, in the Courtland Cir. Courtyard, and Members are Invited to Attend In-Person

The Lenox Place at Sunnyside Homeowners Association (LPAS HOA) monthly meeting of the Board of Directors regularly scheduled for Mon., Jul. 26, at 7 pm, is postponed. The LPAS HOA President has called a Special Meeting of the Board for Tue., Jul. 27, at 7 pm, outdoors in the Courtland Circle courtyard. Its agenda is below. Members are invited to attend the Special Meeting Tuesday evening.

The regular monthly meeting is postponed for reasons relating to this phase of the pandemic and new legislation enacted in Richmond. According to our legal counsel, the end of the Virginia Public Health Emergency Jun. 30 triggered new requirements for the LPAS HOA Board to continue to conduct its meetings virtually. Using email, the Board failed by a Sat., Jul. 24 deadline to unanimously agree to adopt a resolution provided by legal counsel that would have ensured LPAS HOA virtual meetings met the new requirements (by our Bylaws, an action of the Board outside a meeting must be agreed by all Directors to pass). Thus, the regular July virtual Board meeting must be postponed until after the Board adopts the resolution on electronic meetings. Such a resolution is the subject of the in-person Special Meeting called for Tue., Jul. 27.

Special Meeting agenda. This Special Meeting is called by the LPAS HOA President Tue., Jul. 27, at 7 pm, with the following agenda only:

(1) Call to order, presentation of standing rules, public health notice;

(2) Community forum of up to 15 min., members may present up to 5 min. each;

(3) A motion to adopt the resolution recommended by LPAS HOA legal counsel titled ‘Guidelines for Electronic Board and Committee Meetings,’ (resolution text);

(4) If the resolution in (3) passes, notification that the President will call a subsequent Special Meeting three or more days later in a manner consistent with what would have been the regularly scheduled July meeting; and

(5) Adjournment.

This Special Meeting of the Board is being outdoors for two reasons. First, public and church facilities near our community have been asked and declined to host community meetings that are not City agencies. LPAS HOA is not a City agency. Second, the Board may not hold virtual meetings until it adopts the resolution noted above. Dusk, absence of wi-fi coverage important for remote members’ engagement, and summer weather render hosting regular Board meetings outdoors impractical. An exception is being made for this short-agenda Special Meeting.
